Law on - Freedom of Association & Collective Bargaining

KENYA
All workers ( except for members of the police force) are free to form or join unions of their choice and as few as seven workers may establish a union, as long as no union is representing the workers already.

Unions must be registered with the Registrar of Trade Unions. Registration may be refused if the group is already sufficiently represented by another trade union.

That employers shall not engage in interference with the rights of employees to enrol or continue as Union Members or any discrimination, restraint or coercion against any employee because of recognised activity for trade unions.

Unions are allowed to negotiate collective bargaining agreements.

Collective bargaining agreements must be registered with the Industrial Court, and are usually for a period of 1 or 2 years. Once registered, the collective agreement binds parties to comply with the commitments made under it. Collective agreements modify individual contracts.

Benefits are extended to non-union members serving in enterprises where they are in force.

UGANDA
Workers have the freedom to form and join associations or unions, including trade unions and political and other civic organisations.

Requirements to form a trade union are that the workforce represented must have at least 1,000 employees, and the union must represent 51% of the workforce.

Workers have the freedom to assemble and to demonstrate together with others peacefully.

Workers have the right to collective bargaining and representation.

This means that:

Workers should be permitted to form or join the trade union of their choice. If there is no union, management should encourage the formation of a Workers’ Committee. Workers’ representatives should be democratically elected by the workforce. Employers should meet regularly with the union and/or Workers’ Committee. Meetings should be minuted and the minutes displayed on a notice-board. Union members or representatives should not be treated less favourably in any way including hiring, pay or promotion. Workers’ representatives should be allowed to carry out their duties within working hours without losing pay.

Trade unions can help by:

improving communication between employees and managers so that employees can understand and be committed to the organisation's objectives

negotiating improvements to pay and working conditions so that people feel more satisfaction at work and stay longer in their jobs

encouraging companies to invest in training and development so that employees have the skills necessary for improved products and services

acting as a positive force for change by winning employees' support to the introduction of new technologies and work organisation.
